Please read these Terms and Conditions carefully before using Big Asere's delivery service. By placing an order, you agree to be bound by these terms.

1. About Big Asere

Big Asere is a local food delivery service operated by Abraham Oviedo Services, LLC, located at 507 N Dewey St, North Platte, NE 69101. We act as an independent delivery service connecting customers with local restaurants. We are not affiliated with, owned by, or employed by any restaurant we deliver from.

2. Service Area & Hours

• Service area: North Platte, Nebraska — up to 6 miles from the restaurant
• Operating days: Fridays and Saturdays only
• Operating hours: 4:00 PM – 10:00 PM
• Priority Delivery Window: 6:00 PM – 9:00 PM (your order goes first — $3.00 Priority Delivery fee applies)

3. How Ordering Works

Big Asere operates a two-step ordering process:

• Step 1: You place and pay for your food order directly through the restaurant's online menu. The food payment goes directly to the restaurant.
• Step 2: You will receive an SMS with a secure link to pay the delivery fee to Big Asere. Your order will not be dispatched until the delivery fee is paid.

4. Delivery Fees

Delivery fees are based on your distance from the restaurant:

• Zone 1 (0–2 miles): $5.99 standard / $8.99 Priority Delivery
• Zone 2 (2–4 miles): $8.99 standard / $11.99 Priority Delivery
• Zone 3 (4–6 miles): $11.99 standard / $14.99 Priority Delivery

Delivery fees are non-refundable once the driver has been dispatched.

5. Payment

Delivery fees are processed securely through Stripe. We accept all major credit and debit cards, Apple Pay, and Google Pay. Big Asere does not store your payment information. All transactions are encrypted and PCI DSS compliant.

6. Cancellations & Refunds

• You may cancel your delivery request before the driver has been dispatched for a full refund of the delivery fee.
• Once the driver has been dispatched, the delivery fee is non-refundable.
• If your food order is incorrect or missing items, please contact the restaurant directly as Big Asere is not responsible for food preparation.
• If a delivery cannot be completed due to an incorrect address provided by the customer, the delivery fee is non-refundable.

7. Delivery Times

Estimated delivery times are 20–40 minutes depending on your location and current demand. These are estimates only. Big Asere is not responsible for delays caused by traffic, weather, or other circumstances outside our control.

8. Customer Responsibilities

By using our service, you agree to:

• Provide an accurate and complete delivery address
• Be available to receive your order at the delivery address
• Provide a valid phone number to receive delivery updates
• Pay the delivery fee promptly via the SMS link provided

9. Limitation of Liability

Big Asere and Abraham Oviedo Services, LLC shall not be liable for:

• The quality, taste, or accuracy of food prepared by the restaurant
• Delays caused by circumstances outside our control
• Damages exceeding the delivery fee paid for the specific order
• Any indirect, incidental, or consequential damages

10. Independent Contractor Status

Big Asere operates as an independent contractor and is not an employee, agent, or representative of any restaurant. The restaurants we deliver from are independent businesses and are solely responsible for their food products and services.

Big Asere reserves the right to update these Terms and Conditions at any time. Changes will be posted on this page with an updated date. Continued use of our service constitutes acceptance of the updated terms.

13. Governing Law

These Terms and Conditions are governed by the laws of the State of Nebraska. Any disputes shall be resolved in Lincoln County, Nebraska.
